Acceptance of Entry Conditions, Waiver Release/Indemnification and Statement of Intent

DECLARATION WARNING: THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS. A contract in the terms set out below between Triathlon WA (“TWA”) who is the organiser of the Event and the intending competitor shall be deemed to have commenced on the acceptance in writing via email transmission by TWA of the intending competitor’s application to compete.

In consideration of and as a condition of acceptance of my entry in the 2010 Busselton Half Ironman Triathlon (“Event”):

  • 1.       I have read, understood and accepted all information contained on the Event website (www.busseltonhalf.com), including “Conditions of Entry”, and acknowledge and agree that such information together with any additional rules laid down by Triathlon Australia and additional documentation I will receive from TWA once my entry is accepted shall constitute the entry conditions and rules applying to the Event.

  • 2.       I hereby attest and verify that the information I have supplied to the organizers in my entry registration is true and correct and I understand that any false information which may be found to have been deliberately provided by me, may lead to my withdrawal from the Event and render me ineligible to compete in any future Triathlon within the jurisdiction of Triathlon WA, Triathlon Australia or World Triathlon Corporation.

  • 3.       I hereby attest and verify that I am physically fit and have sufficiently trained for the Event and that my physical condition has been verified by a registered medical practitioner in order to compete in the Event. I further attest and verify that I do not have any physical or intellectual impairment that may make my participation unsafe for myself or others.

  • 4.       I undertake to immediately notify TWA of any change to my medical status or condition, as verified in Point 3 above, that is likely to affect my fitness to compete in the Event, for consideration by the Event Medical Director.

  • 5.       I, for myself, my heirs, my executors and administrators hereby waive and release all and any claim, right or cause for action which I or they might otherwise have for, or arising out of loss of life or injury, loss or damage of any description whatsoever which I may suffer or sustain in the course of or consequent upon my entry or participation in the Event.

  • 6.       I hereby acknowledge that I have sole responsibility for my personal possessions and athletic equipment during the Event and any related activities and functions.

  • 7.       I hereby consent to receive such medical treatment that may be deemed advisable in the event of injury, accident and/or illness during the Event.

  • 8.       I agree to comply with all the rules and directions of Event officials and their servants and/or agents.

  • 9.       I hereby agree that my entry to this race is non transferable to any other individual or to any other event.

  • 10.   I hereby grant to TWA and contractors and suppliers engaged by TWA in connection with the Event a royalty free right to use my name, image and likeness in broadcasts, telecasts, webcasts, media press and materials and promotional materials connected to the Event.

  • 11.   I hereby agree that if the Event is cancelled due to storm, rain, inclement weather, winds or other “Act of God” conditions or other factors beyond the control of TWA, my entry fee shall be non-refundable.

  • 12.   I acknowledge that upon completion of this entry registration a cancellation fee will be applicable to my entry fee. For further information on this cancellation fee please refer to the website (www.busseltonhalf.com) No refunds will be provided after the 15th April 2010

  • 13.   I hereby acknowledge this waiver, release and discharge shall operate separately in favour of all persons, contractors, corporations, associations and bodies involved or otherwise engaged in promoting or staging the Event and their servants, agents, representatives and officers and includes, but is not limited to, the various committees, TWA and its contractors, Triathlon Australia,  the World Triathlon Corporation, Shire of Busselton, WA Police, WA Ambulance Service, WA Surf Life Saving and Event sponsors and suppliers, and shall operate whether or not the loss injury or damage is attributable to an act or omission of any one or more of them.

  • 14.   I understand that TWA will use an electronic chip device for timing all competitors in the Event and this will entail the issuing of the device on loan to me and wearing of the device by me. I undertake to return this device as soon as I have completed (or withdrawn from) the Event and to pay TWA an amount of $AUD55 (including GST) if I fail to return the said device at the finish of (or upon earlier withdrawal from) the Event.

  • 15.   I acknowledge that proceeding with my registration online or in writing indicates I have read this waiver in full and agree to all the conditions of entry.

Notes about 2010 Race Entry Fees

Over the past few years, our event has been growing in size and popularity and with this, we have embraced this progression and for 2010 Triathlon WA will be implementing a few changes to the Busselton Half Ironman Triathlon.

Along with these changes there are associated cost increases; however we aim to keep costs to the competitor to the minimum. Triathlon WA is a not for profit organisation utilising any proceeds raised from the SunSmart Busselton Festival of Triathlon for the conduct and progression of the sport of triathlon in Western Australia.

The main cost component increase for the 2010 Busselton Half Ironman entry fee is as a result of theinclusion of an athlete function/meltdown party/medal ceremony following the Busselton Half Ironman Triathlon on Saturday 1st May 2010, from 6pm at Barnard Park in a purpose built function marquee. All participants, including each team member will receive an entry ticket to this function as part of their entry fee.

Additional tickets for other attendees to the athlete function/meltdown party/medal ceremony will be available for purchase online with your race entry or individually until sold out.

The athlete function/meltdown party/medal ceremony ticket will include entry to the function, buffet food selection, one free beverage, medal ceremony presentations, DJ and dancing. A fully licensed bar will be available onsite.

Please note that aside from the athlete function costs, the entry fee is nominally higher than previous years and this can be attributed to the following other factors:

  • Event Village infrastructure changes to accommodate athlete function
  • Change in bike course to 2 laps - traffic management costs, road closure costs, additional aid station costs
  • General increase in costs associated with event - security, administration, athlete packs, logistics etc

A MAXIMUM field of 1400 Individuals and 200 teams
will be allocated to the Busselton Half Ironman Triathlon 2010.
